BRIGHT START SPORTS:

This Refund and Cancellation Policy forms part of the terms and conditions governing all bookings made with BRIGHT START SPORTS LTD ("we", "our", "us"). By making a booking for any extracurricular club,  delivered by us, you agree to be bound by this policy.

All refunds, credits and fee reductions are subject to the provisions set out below.
 

1. EXTRACURRICULAR CLUBS
1.1 Cancellation Before the First Session
 

If a parent or guardian cancels a club booking at least 48 hours before the first scheduled session, a refund of 75% of the fees paid will be issued. The remaining 25% shall be retained to cover administration, staffing, venue and operational costs. No refund will be issued where cancellation is made less than 48 hours before the first scheduled session.
 

1.2 No Refunds Once Attendance Has Commenced

Once a child has attended one or more scheduled club sessions, whether in full or in part, the booking shall become strictly non-refundable. No refunds, credits, transfers or fee reductions will be provided in circumstances including, but not limited to:

• A child choosing not to continue attending;

• A child not enjoying the club;

• A change in personal circumstances;

• Holidays or travel arrangements;

• School activities or commitments;

• Illness or sickness;

• Medical appointments;

• Family commitments;

• Failure to attend for any reason whatsoever.

The non-attendance of one or more sessions shall not affect the parent's or guardian's obligation to pay the full booking fee.

1.3 Serious Injury Provision

In exceptional circumstances, where a child sustains a serious injury that genuinely prevents participation in the activity, we may offer a discretionary fee reduction against a future club booking.

To qualify:

• The injury must be supported by appropriate medical evidence;

• The injury must prevent participation for three (3) or more consecutive paid club sessions;

• The absence must be directly attributable to the injury.
   

Examples of qualifying injuries may include broken bones or other medically verified injuries that prevent active participation. No cash refund shall be issued under this provision. Where approved, a reduced fee may be offered on a future booking when the child returns to participation.

This provision does not apply to:

• Illness or sickness;

• Minor injuries;

• Any absence not caused by a qualifying serious injury.

Any reduction offered shall be entirely at the discretion of BRIGHT START SPORTS LTD, whose decision shall be final.

2. HOLIDAY CAMPS

2.1 Cancellation by Parent or Guardian

Holiday camp bookings may be cancelled subject to the terms below.

Cancellation at Least 48 Hours Before the Camp Day

Where cancellation is received at least 48 hours before the start of the booked camp day, a refund of 75% of the fees paid will be issued.

The remaining 25% shall be retained to cover administration, staffing and operational costs.

Cancellation Less Than 48 Hours Before the Camp Day

No refund will be issued.

2.2 Non-Attendance

No refund, credit or transfer will be provided where a child:

• Fails to attend;

• Arrives late;

• Leaves early;

• Does not wish to participate;

• Misses a camp day due to illness, sickness, holiday, injury or any other personal circumstance.

 

2.3 Serious Injury Provision

Where a child sustains a serious injury and is unable to attend for three (3) or more consecutive booked camp days, and appropriate medical evidence is provided, we may offer a discretionary credit or fee reduction against a future booking.

No cash refund shall be provided under this provision.

The value of any credit or reduction shall be determined solely by BRIGHT START SPORTS LTD.

 

3. BIRTHDAY PARTIES

3.1 Customer Cancellations

Cancellation More Than Seven (7) Days Before the Party

Where cancellation is received more than seven (7) days prior to the scheduled start time of the party, a refund of 50% of the fees paid will be issued.

Cancellation Between Seven (7) Days and Forty-Eight (48) Hours Before the Party

Where cancellation is received less than seven (7) days but more than forty-eight (48) hours before the party start time, a refund of 25% of the fees paid will be issued.

Cancellation Within Forty-Eight (48) Hours of the Party

No refund will be issued.

 

3.2 Failure to Proceed

No refund shall be payable where:

• The customer decides not to proceed with the party;

• Guests fail to attend;

• Attendance numbers are lower than anticipated;

• The event is cancelled by the customer less than 48 hours before the scheduled start time.

 

4. CANCELLATION BY BRIGHT START SPORTS LTD

If we cancel an extracurricular club, holiday camp or birthday party due to circumstances within our reasonable control and no suitable alternative arrangement can be provided, a refund of the fees paid for the affected activity shall be made.

Where cancellation occurs as a result of circumstances beyond our reasonable control, including but not limited to:

• Extreme weather;

• Venue closure;

• Acts of God;

• Government restrictions;

• Public health emergencies;

• Industrial action;

• Utility failures;

• Any other force majeure event,

we reserve the right to provide an alternative session, transfer, credit note or rescheduled activity in place of a cash refund.

 

5. REFUND PROCESSING

Approved refunds will be returned using the original payment method wherever reasonably possible.

Refunds will normally be processed within fourteen (14) days of approval.

 

6. GENERAL PROVISIONS

All requests for cancellations, refunds, credits or fee reductions must be submitted in writing to bookings@brightstartsports.com.

Nothing in this policy is intended to exclude or limit any rights that cannot lawfully be excluded or limited under applicable consumer protection legislation.

Except where required by law, no refunds, credits or compensation shall be payable other than as expressly set out in this policy.
